Bright Light Education UK LLP. Terms and Conditions for our Tutor Referral Agency

Bright Light Education UK LLP is a registered Limited Liability Partnership (Partnership Number: OC434332), whose registered office is situated at 72 Dover House Road, SW15 5AT.  The website is https://brightlighteducation.co.uk.

Bright Light Education UK LLP acts as agents on behalf of the tutor (Tutor) and will introduce the Tutor to the client (Client).

You are referred to as ‘the Client’. You agree to the purchase of tutoring services on behalf of ‘the Student’. ‘The Student’ may be yourself or another person. The Student is the person who receives the tutoring service through sessions of tutoring, either in person or online.

The terms “us/we/our” refer to Bright Light Education UK LLP.

The “Tutor” is the person who tutors the Client or Student.

“Engagement” means the engagement, employment or use of the Tutor by the Client.

“Introduction” means the Client’s interview of a potential Tutor in person or by telephone, following the Client’s instruction to Bright Light Education UK LLP to search for a Tutor.

“Sessions” means a period of time during which the Tutor promises to engage in tuition for the Client, for which the Client promises to pay the Tutor.

If you continue to engage with Bright Light Education UK LLP, you are agreeing to these Terms and Conditions of Bright Light Education UK LLP.

Bright Light Education UK LLP is a member of The Tutors’ Association, which is the only professional membership body for tutoring and the wider supplementary education sector in the UK. As a member, we have signed and must adhere to the “Code of Professional Practice for Tutoring Companies” and all of our Tutors must sign and adhere to the “Code of Ethics for Tutors”. Both documents are available upon request.

Bright Light Education UK LLP is an agent for the introduction of one or more tutors to a Client. This is our “Tutor Referral Agency”. The aim of the Tutor Referral Agency is to be able to offer the prospective Client a range of Tutors who they can contact for tuition. These tutors are self-employed and are entirely responsible for their relationship with their Client including lesson content.

Our Tutors must be qualified teachers with enhanced DBS checks (unless stated otherwise on the tutor profile). Before we allow tutors to join our network, we interview them to ensure that their teaching values are in line with our own. We also require them to sign an Agreement with us to show their commitment and professional attitude towards teaching. They must also read, understand and agree to these Terms and Conditions, as well as our Safeguarding and Privacy Policies. We sometimes require references from their employers. All our Tutors are self-employed. Whilst every care and reasonable effort is made to check the suitability of the Tutors, we strongly recommend that the Client make their own enquiries and checks. Bright Light Education UK LLP holds no responsibility for the tutors’ insurances, policies and teaching methods.

Our Tutors are self-employed. When working as part of our Tutor Referral Agency, they are entirely responsible for their relationship with their Client, including correspondence and teaching. It is the Client’s responsibility to inform the Tutor of medical conditions or Special Educational Needs and Disabilities, that they feel the Tutor should know about.

We recommend that the Tutor teaches at the Client’s home or online, but this is a decision that can be made between Client and Tutor directly.

Bright Light Education UK LLP shall not be liable under any circumstances for any loss, expense, damage, delay, costs or compensation (whether direct, indirect or consequential) which may be suffered or incurred by the Client arising from or in any way connected with Bright Light Education UK LLP seeking a Tutor for the Client or from the Introduction to or Engagement of any Tutor by the Client or from the failure of Bright Light Education UK LLP to introduce any Tutor. For the avoidance of doubt, Bright Light Education UK LLP does not exclude liability for death or personal injury arising from its own negligence.

The Client is not permitted to make private arrangements for tuition with a Tutor introduced by Bright Light Education UK LLP.

A breach of this term will render the Client liable to Bright Light Education UK LLP for any sums paid direct to the Tutor without deduction and Bright Light Education Ltd shall be entitled to seek an injunction against the Client to prevent further breaches. This obligation continues beyond the termination or conclusion of this agreement.

As agent for the tutor, the billing process will be under the control of BLE UK LLP, who on behalf of the Tutor will send a statement of fees for the tuition to the Client at the start of each calendar month. Payment must be made to BLE UK LLP, who will be receiving the tuition fees on behalf of the Tutor within 10 days of receipt.

The fees will be calculated based upon the timesheets submitted by the Tutor. The Client shall ensure that each timesheet is checked. The timesheets are sent to Bright Light Education UK LLP at the end of each calendar month.

Fees are inclusive of a Client Platform Fee, of which VAT is included within that amount.

Payment must not be made to the Tutor at any time.

Fees are non-refundable once the lesson has taken place.

Small Group Lessons: Some tutors may teach small group sessions within the Tutor Referral Agency. In some cases, these lessons will be charged in advance to cover the half term ahead. In these cases, the tutor will state in advance the payment policy.

Please note that for clients paying outside of the UK who do not hold a UK bank account, payment can be made via international bank transfer, by PayPal or Wise. Please note the client must pay all transfer costs and all fees for international payments. Please ensure you inform us if you are paying invoices from an account outside the UK and EU, as this may affect VAT.

All expenses (including books and travel) must be agreed with the Tutor in advance.

If one lesson needs to be cancelled by the Client, the Client must make suitable arrangements with the Tutor at least two weeks in advance. The Tutor will make every effort to re-arrange that lesson, but the Tutor is not obliged to do this if it is not possible. If a lesson is cancelled by the Client within 24 hours of the lesson (excluding weekends and bank holidays), the Client must pay for the missed lesson at their normal rate.

The Client can request to stop tutoring sessions with the Tutor at any time but must pay for all lessons that have taken place.

Small Group Lessons: For small group lessons, the tutor will outline their cancellation policy. In most cases, once dates have been agreed, full payment is required to cover the agreed lessons (either in advance or at the end of each month) and payments are non-refundable.

Bright Light Education UK LLP reserves the right to request that a Tutor stops arranging sessions with the Client at any time.

The Client confirms that they have read, understood and agrees to the following policies of Bright Light Education Ltd. These policies are:

Safeguarding Policy https://brightlighteducation.co.uk/safeguarding-policy/

Privacy Policy https://brightlighteducation.co.uk/privacy-policy/

We have no liability in respect of any arrangement you may choose to enter at your discretion with a Tutor. Our liability to you under the Contract is limited to the fees that you pay to us in respect of those services, although we do not exclude or limit our liability for death or personal injury caused by our negligence, fraud or for any other liability that cannot be legally excluded or limited. We will not be liable for any failure to provide services where we are prevented from doing so by an event outside of our reasonable control.

This agreement is governed by the laws of England and Wales and the parties submit to the jurisdiction of the Courts of England and Wales.

These terms constitute the whole agreement between the Client and Bright Light Education UK LLP and no variation or alteration of these terms shall be valid unless approved in writing by a partner of Bright Light Education UK LLP. Bright Light Education UK LLP reserves the right to alter these terms and conditions and will notify the Client in writing of any changes.

The Client acknowledges that these terms govern the legal rights and obligations between the Client and Bright Light Education UK LLP.
